By accessing or using Arqentia Pulse ("the Service"), provided by Arqentia LLC, a Florida limited liability company ("Arqentia", "we", "us"), you agree to these Terms. If you do not agree, do not use the Service.
Arqentia Pulse analyzes publicly accessible websites and generates a diagnostic report including SEO, performance, security, content and UX signals. The Service uses automated tools and AI models to produce its outputs. Free reports show partial results; full reports require payment.
You represent that any URL you submit is owned by you or that you are otherwise authorized to request its analysis. You will not submit URLs of websites you do not have authority over for purposes other than the public diagnostic the Service provides. You will not use the Service to violate the rights of any third party.
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. Reports include estimates of revenue impact, traffic and competitive positioning that are approximations based on industry benchmarks and the data available at scan time. We do not guarantee any specific business outcome, ranking change, traffic increase, or revenue gain.
To the maximum extent permitted by law, Arqentia's total cumulative liability for any claim arising out of or related to the Service is limited to the amount you paid for the Service in the twelve (12) months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.
Paid tiers (Full Report, Quick Fix, Full Optimization, Ongoing Partner) are billed through our payment processor. One-time products are non-refundable once delivered. Subscription products may be cancelled at any time and remain active through the end of the paid period. Billing currency is USD unless otherwise noted.
The Service, including software, methodology, brand and design, is owned by Arqentia. The report content delivered to you may be used by your business; the underlying methodology, code and templates remain Arqentia's property. You may not resell, sublicense, or republish the report or the Service without written consent.
Reports incorporate publicly available data from third-party sources (DNS, WHOIS, certificate transparency, Google PageSpeed Insights, Mozilla Observatory, public ad libraries, etc.). Trademarks and brand names referenced are property of their respective owners and used solely for descriptive comparison.
You will not use the Service to (a) attempt unauthorized access to any system, (b) circumvent security or rate limits, (c) scrape, copy, or harvest the Service's outputs in bulk, (d) submit illegal or infringing content, or (e) harass, defame, or violate the rights of others.
We may suspend or terminate access at any time for breach of these Terms or for activity that we believe is harmful. You may stop using the Service at any time.
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Service shall be resolved by binding arbitration in Miami-Dade County, Florida, administered by the American Arbitration Association under its Commercial Arbitration Rules. You waive any right to participate in a class action. Either party may seek injunctive relief in court for IP misuse.
We may update these Terms periodically. The "Effective date" above will reflect the most recent change. Continued use after changes constitutes acceptance.
